ZONE CODE TEXT AMENDMENT No. ZCTA17-001

Merced County – A proposed amendment to Title 18 (Zoning) of the Merced County Code to provide for the creation of accessory dwelling units (ADUs) in certain residential zones consistent with the requirements of State Government Code Section 65852.2. The amendment defines a new residential use, "accessory dwelling unit"; establishes which residential districts the use is permitted; and establishes appropriate development standards. Additionally, this amendment will also amend the Code to remove “Granny house,” “Guest house,” and “Secondary residential unit” as allowable uses in the R-1, R-1-5000 Single-family Residential Zones; and in the R-3 and R-4 Multiple-family residential zones. The provisions of this text amendment would be effective in all unincorporated areas of the County of Merced. CEQA: The project is exempt from CEQA pursuant to CEQA Section 15282 (h) – “Other Statutory Exemptions". DL

RECOMMENDATION(S):
1. Open/Close the public hearing;
2) Recommend the Board of Supervisors find the project exempt from CEQA pursuant to CEQA Section 15282 (h) – “Other Statutory Exemptions"; and,
3) Recommend the Board of Supervisors adopt the ordinance.
