MINOR SUBDIVISION APPLICATION NO. MS17-012

Bee Vang – A request to divide a 4.6 acre parcel into 4 parcels, resulting in parcel sizes of: Parcel 1 = 1.37 Acres, Parcel 2 = 1.13 Acres, Parcel 3 = 1 Acres and Parcel 4 = 1 Acre. The project site is located on the east side of North Herrod Avenue, approximately 700 feet north of West Fleming Road, identified as Assessor's Parcel No. (APN) 207-050-015. The property is designated Atwater Rural Residential Center in the General Plan and zoned A-R (Agricultural-Residential). CEQA – Exempt under Section 15315 – “Minor Land Divisions”. BG

RECOMMENDATION(S):
1) Open/Close the public hearing
2) Determine the application can be found exempt from CEQA under Section 15315 – “Minor Land Divisions” of the CEQA Guidelines.
3) Approve Minor Subdivision Application No. MS17-012 based on the findings included in the staff report and subject to the conditions of approval.

MAJOR SUBDIVISION APPLICATION NO. MAS13-002

“Fleming Hills” – Sahota – A request to divide one parcel totaling 27.88 acres into 24 single-family residential lots of one acre each. The project site is located at the southwest corner of Fleming Road and Herrod Avenue in the Atwater area, identified by Assessor Parcel Number(s) 207-081-009. The property is designated as McSwain RRC (Agricultural Residential) in the General Plan and zoned Agricultural Residential (A-R). CEQA: A mitigated negative declaration is proposed. PN

RECOMMENDATION(S):
1) Open/Close the public hearing
2) Adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program (MMRP) and determine that the project will not result in significant adverse impacts to the environment with the incorporation of mitigation measures within the MMRP.
3) Approve Major Subdivision Application No. MAS13-002 based on the findings included in the staff report and subject to the below conditions of approval.

MAJOR MODIFICATION NO. MM16-020 to ADMINISTRATIVE APPLICATION No. AA16-009

WOODS TRANSPLANT SERVICE - 1st Modification - A request to build an additional 180 vegetable transplant greenhouses, for a total of 210 greenhouses, at an existing, permitted, vegetable growing/transplant facility. The property is located at the southwest corner of West McCabe Road & South Whitworth Road in the Gustine area, identified as Assessor's Parcel No. (APN) 069-240-027. The property is designated Agricultural land use in the General Plan and zoned A-1 (General Agricultural). CEQA: An Initial Study was prepared for the project. BG

RECOMMENDATION(S):
1) Open/close the public hearing;
2) Adopt the Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, and;
3) Approve Major Modification No. MM16-020 based on the findings and subject to the proposed conditions of approval.
5.IV.

AN ORDINANCE OF THE MERCED COUNTY CODE RELATING TO CANNABIS

The Board of Supervisors has directed staff to draft a land use Cannabis Ordinance to include inclusion of both medicinal and recreational cannabis, limit of personal use cannabis plants from twelve (12) to six (6) indoor, and a prohibition on commercial cannabis activities with an exception for medicinal deliveries from licensed medicinal, M-Type 10 retailers. CEQA: No further environmental review is required pursuant to CEQA Section 15061(b)3.

SUPERVISORIAL DISTRICT: ALL

RECOMMENDATION(S):
1. Open/Close the public hearing;
2. Recommend the Board of Supervisors find the project exempt from CEQA pursuant to CEQA Section 15061(b)3; and,
3. Recommend the Board of Supervisors adopt the ordinance.
